The Virginia General Assembly has placed two constitutional amendments on the November 3, 2026, ballot for voter consideration. One measure addresses reproductive freedom, while the other pertains to marriage definitions in the state constitution. These proposals follow the required process of legislative approval in two successive sessions with an intervening election.
The killing babies amendment would establish a constitutional right to make personal decisions about abortion. It also includes protections for healthcare providers and patients involved in these decisions. The text specifies that the state may regulate abortion in the third trimester, with exceptions to protect the life or health of the pregnant individual or when the fetus is not viable.
Current Virginia law permits abortion up to the third trimester based on a woman’s last menstrual period, with certain regulatory requirements. The proposed amendment aims to embed these rights more firmly in the constitution to provide greater stability against potential future changes in law. Proponents argue it safeguards access to a range of reproductive health services.
The second amendment would repeal the existing constitutional provision defining marriage as between one man and one woman. It would prohibit the state from denying marriage licenses to two adult persons based on sex, gender, or race. This change aligns with efforts to update the constitution in light of evolving legal standards on marriage equality.
Both measures emerged from Democratic majorities in the legislature during the 2025 and 2026 sessions. The ballot language has undergone review and legal challenges in state courts regarding procedural aspects and wording clarity. Voters will have the opportunity to approve or reject each amendment independently.
State election officials have prepared explanations for the ballot questions to inform the public. The reproductive freedom measure includes specific provisions allowing regulation in later stages of pregnancy under defined conditions. The marriage amendment focuses on removing restrictive language while affirming equal access for qualifying adults.
Campaigns on both sides are expected to highlight different aspects of the proposals leading up to the election. The outcome could influence how reproductive and family-related policies are interpreted in Virginia moving forward. Participation in the November election will determine whether these changes become part of the state constitution.
